Lake County Arrest Report

Arrest records and arrest reports, though used interchangeably, differ. An arrest record is the official document that summarizes a person's being taken into custody and booked into the county jail system. It is prepared by the arresting law enforcement agency (such as a sheriff's office or a municipal police department) and is essential for case tracking and for updating a person's criminal history. Arrest reports, on the other hand, are narrative documents created by the arresting officer to detail everything that happened during the arrest. It contains their observations, the sequence of events, witness testimonies, and evidence justifying the arrest. Both arrest records and arrest reports are public information, but arrest reports are more redacted as they contain sensitive information (witness information, victim information, etc).

How to Get an Arrest Record Expunged in Lake County

Expungement is the legal removal of an arrest from a person's criminal history and restoring the privileges they had before the arrest. Expungement is allowed under Illinois law and processed by the 19th Judicial Circuit Court and the Lake County Circuit Clerk if the case meets the expungement requirements. In addition to expunction, Illinois also offers sealing of records, which hides the record from public view but does not destroy it, unlike expungement.

The expunction process is governed by 20 ILCS 2630/5.2 Criminal Identification Act. Under this law, cases that can be expunged include arrests that did not lead to a conviction, dismissed charges, and acquittals. etc. Most misdemeanor charges can be sealed except for violent, sexual, and DUI-related arrests.

How Do You Remove Lake County Arrest Records From the Internet?

To remove an arrest record from the internet, the record needs to be expunged or sealed. When an expunction or sealing is granted, an order is given by the court that mandates government agencies to remove or delete the record from their databases and websites. These agencies include arresting agencies and the courts, making it not accessible during background searches. Illinois law does not, however, extend to private websites, but individuals can appeal to them with a court order to have their record voluntarily taken down from the website.
